These Terms of Service ("Terms") set out the conditions for using Sho (the "Service"), provided by Guinea Pig LLC (the "Operator"). Please agree to these Terms and the Privacy Policy before using the Service.

§Article 1. Scope

  1. These Terms apply to all relationships between users and the Operator concerning the use of the Service.
  2. Any rules the Operator sets out separately within the Service form part of these Terms.

§Article 2. Definitions

  • "User" means anyone who uses the Service, including visitors who have not registered an account.
  • "Registered User" means a User who has registered an account.
  • "Card" means text created by a Registered User on the Service, including the images it contains.
  • "Public Card" means a Card whose visibility is set to "Public" so that anyone can view it.

§Article 3. Accounts

  1. You must register an account yourself, after agreeing to these Terms and the Privacy Policy. By registering, you are deemed to have agreed to both.
  2. Registered Users must keep their registered information accurate and are responsible for keeping their password safe.
  3. You may not transfer or lend your account to anyone else.
  4. The Operator may refuse a registration if it considers the registration inappropriate, for example if the applicant has previously been subject to a measure under Article 7.

§Article 4. Minors

  1. You may not register an account if you are under 16 years old.
  2. If you are under 18 years old, you must obtain the consent of a parent or other legal guardian before using the Service.

§Article 5. Rights to Cards

  1. Copyright and all other rights in a Card belong to the Registered User who created it (or to the relevant rights holder). The Operator does not acquire these rights.
  2. Registered Users grant the Operator a free license to store, reproduce, display, and transmit their Cards to the extent necessary to provide, maintain, and improve the Service. This license ends when the Card is deleted. However, for backups made before the deletion, the license continues until those backups are erased.
  3. Any User can view Public Cards. Registered Users are responsible for their own visibility settings.
  4. Registered Users warrant that their Cards do not infringe the copyright, privacy, or any other rights of third parties.

§Article 6. Prohibited Conduct

When using the Service, you must not:

  1. Violate laws, regulations, or public order and morals
  2. Infringe the copyright, trademark, privacy, reputation, or any other rights or interests of third parties
  3. Impersonate another person, or pretend to be affiliated with the Operator
  4. Publish personal information of third parties without their consent
  5. Publish content that is seriously offensive to other Users, such as obscene, discriminatory, or violent content
  6. Send advertising, promotion, or solicitation that the recipient did not agree to, or engage in spamming
  7. Gain unauthorized access, place excessive load on the Service's servers or network, or otherwise interfere with the operation of the Service
  8. Exploit vulnerabilities of the Service (except for checks necessary to report them to the Operator)
  9. Register accounts or create Cards in bulk by automated means
  10. Post content that contains malware, or that leads to phishing or other fraud
  11. Engage in any other conduct the Operator considers inappropriate

§Article 7. Hiding or Deleting Cards, and Suspending or Deleting Accounts

  1. If the Operator determines that a User falls under any of the following, it may, without prior notice, take one or more of these measures: hiding the relevant Cards, deleting them, or suspending or deleting the account.
    • The User has violated these Terms
    • The registered information is false
    • A rights holder or public authority has made a justified request for removal
    • The User cannot be contacted for a long period
    • The Operator otherwise considers the User's use of the Service inappropriate
  2. The Operator may delete an account with no login for a long period, together with its Cards and images, after notifying the registered email address in advance.
  3. The Operator is not liable for any damage caused to a User by the measures in the preceding two paragraphs.
  4. The Operator is not obligated to explain the reasons for the measures in paragraph 1.
  5. Reports of Cards that infringe the rights of third parties are accepted as described on the Report Content page.

§Article 8. Leaving the Service

  1. Registered Users can delete their account and leave the Service at any time from the Settings page.
  2. When you leave, your account information, Cards, and images are deleted immediately and cannot be restored. Download any Cards you need before leaving.

§Article 9. Changes, Interruption, and Termination of the Service

  1. The Operator may change the content of the Service without prior notice to Users.
  2. The Operator may interrupt all or part of the Service for system maintenance, failures, natural disasters, or other unavoidable reasons.
  3. The Operator may terminate the Service after announcing it on the Service a reasonable period in advance.

§Article 10. Disclaimer

  1. The Service is provided as is. The Operator does not guarantee that the Service fits any particular purpose of Users, that it is free of defects, or that Cards will not be lost. Please download important Cards and keep a copy yourself.
  2. The Operator is not liable for any damage caused to Users by the use of the Service, except where caused by the Operator's willful misconduct or gross negligence.
  3. Disputes between Users, or between a User and a third party, are to be resolved by the parties involved.

§Article 11. Changes to These Terms

  1. The Operator may change these Terms in the following cases:
    • When the change is in the general interest of Users
    • When the change does not go against the purpose of these Terms and is reasonable in light of the need for the change, the appropriateness of the new content, and other circumstances relating to the change
  2. When changing these Terms, the Operator will announce the effective date and the new content on the Service before that date.

§Article 12. Governing Law, Jurisdiction, and Language

  1. The Service can be used from outside Japan, but it is operated under the laws of Japan. These Terms are governed by the laws of Japan.
  2. Any dispute concerning the Service is subject to the exclusive jurisdiction, as the court of first instance, of the district court that has jurisdiction over the location of the Operator's head office.
